Terms of Service

Welcome to the AI photobooth experience (the “Service”) operated by Top Shelf Brands (“Top Shelf Brands,” “we,” “us,” or “our”). By using the Service you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Service.

1. The Service

The Service allows you to provide a name, choose a scene location, and take a selfie that is processed by an AI model to generate a personalized postcard. You may choose to have the finished postcard delivered to you by SMS text message or email.

2. Eligibility

You must be at least 18 years old, or the age of majority where you live, to use the Service. Do not use the Service if you cannot enter into a binding agreement with Top Shelf Brands.

3. Information You Provide

To use the Service you may provide your name, a scene location selection, a selfie photograph, and either a mobile phone number or an email address for delivery of your generated postcard. You represent that the information you provide is your own and that you have the right to share it. Our handling of this information is described in our Privacy Policy.

4. SMS Text Messages

If you choose SMS delivery and provide your mobile number, you consent to receive a one-time text message from Top Shelf Brands containing your generated avatar card. Top Shelf Brands is the sender of the message. Standard message and data rates may apply. You may opt out of any further messages at any time by replying STOP. For help, reply HELP. By providing your number you confirm that the number is yours, that you are authorized to receive text messages on it, and that you consent to receive the message via an automated texting service. Consent to receive text messages is not a condition of using the Service.

5. Email Messages

If you choose email delivery and provide your email address, you consent to receive a single email from Top Shelf Brands containing your generated avatar card. We do not add your address to any marketing list and we will not send you promotional email through the Service.

6. Acceptable Use

You agree not to use the Service to: (a) submit a photograph of anyone other than yourself without their permission; (b) submit a name or content that is unlawful, threatening, defamatory, hateful, sexually explicit, or otherwise inappropriate; (c) impersonate any person; (d) interfere with the Service; or (e) violate any law.

7. Generated Content

You retain ownership of the selfie photograph and personal details you provide. You grant Top Shelf Brands a limited, revocable license to use those inputs only to generate, deliver, and display your avatar card through the Service. The generated avatar card is provided for your personal, non-commercial use.

8. Disclaimer of Warranties

The Service is provided on an “AS IS” and “AS AVAILABLE” basis. To the fullest extent permitted by law, Top Shelf Brands disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. AI-generated output may not accurately resemble you and is provided for entertainment purposes.

9. Limitation of Liability

To the fullest extent permitted by law, Top Shelf Brands and its affiliates will not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of the Service. Top Shelf Brands’s total liability for any claim relating to the Service will not exceed one hundred U.S. dollars (US $100).

10. Changes to the Terms

We may update these Terms from time to time. The “Last updated” date at the top reflects the most recent revision. Continued use of the Service after a change constitutes acceptance of the updated Terms.
